TERMS OF SERVICE (Kalam)

1) Acceptance of Terms

By downloading, accessing, or using Kalam (the “App”) or our websites and related services (collectively, the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. If you are under the age required by law in your jurisdiction, a parent or legal guardian must accept these Terms on your behalf.


2) Eligibility & Account

  • You must be capable of forming a binding contract and comply with these Terms and applicable laws.

  • You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of unauthorized use.


3) Subscriptions, Trials, Billing & Auto‑Renew

  • Plans & trials. We offer monthly, quarterly, and annual plans. Some plans include a 3–7 day free trial (as shown at checkout). Trials are one per customer unless expressly stated otherwise.

  • Auto‑renew. Subscriptions auto‑renew for the same term at the then‑current price unless you cancel at least 24 hours before the end of the current term or trial.

  • Purchase channel controls refunds.

    • Apple In‑App Purchase (IAP): Apple is the merchant of record. Refunds and billing issues for IAP are handled by Apple (manage/cancel in iOS Settings → Apple ID → Subscriptions; refunds at reportaproblem.apple.com).

    • Web (Stripe): Kalam App LLC is the merchant of record. Manage/cancel via our Billing Portal (link in receipt and account settings). Refund terms appear in our Refund & Cancellation Policy.

  • Price changes. We may change prices or features prospectively and will provide notice as required by law/platform policies.

  • Taxes. Prices may exclude applicable taxes, which may be added at checkout.


4) Acceptable Use

You agree not to: (a) misuse or interfere with the Service; (b) reverse engineer or bypass security; (c) transmit malware; (d) infringe intellectual property or privacy rights; (e) harass, abuse, or post unlawful content; (f) use the Service to develop or train competing models/services except as permitted by law.


5) Audio/Speech Features

The Service provides speaking drills, voice recognition, and pronunciation feedback. You consent to microphone access and to the processing of audio snippets, derived transcripts, and scores to deliver feedback, improve quality, and prevent abuse. See the Privacy Policy for details and controls.


6) Intellectual Property & License

The Service (software, content, designs, and marks) is owned by Node Zero Inc and/or its licensors. Subject to these Terms and any applicable fees, we grant you a limited, non‑exclusive, non‑transferable, revocable license for personal, non‑commercial use. You retain ownership of your submissions and grant us a worldwide, royalty‑free, sublicensable license to host, process, display, and analyze them to operate and improve the Service.


7) Third‑Party Services

We integrate third‑party services (e.g., speech/voice vendors, analytics, payments). Their terms and privacy policies govern your use of those services. We are not responsible for third‑party content or practices.


8) Termination

We may suspend or terminate access for violations of these Terms, suspected fraud/abuse, or legal compliance. You may stop using the Service at any time; cancellation/refund rights depend on your purchase channel.


9) Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non‑infringement. We do not warrant uninterrupted or error‑free operation.


10) Limitation of Liability

To the extent allowed by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses of profits, data, or goodwill. Our total liability for claims relating to the Service will not exceed the greater of $100 or the amounts you paid in the 12 months preceding the claim. Some jurisdictions do not allow certain limitations; those limits apply to the maximum extent permitted.


11) Indemnification

You will indemnify and hold harmless Node Zero Inc, Kalam App LLC, and their officers, directors, employees, and agents from claims and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, violation of these Terms, or infringement of rights.


12) Dispute Resolution; Arbitration; Class Waiver (US)

  • Governing law. Wyoming law governs (without regard to conflicts rules), except where preempted by platform/consumer laws.

  • Binding arbitration. Disputes arising out of or relating to the Service/Terms shall be resolved by binding arbitration administered by JAMS or AAA, conducted in Sheridan County, Wyoming, in English. You and we waive jury trial.

  • Class‑action waiver. Disputes must be brought individually.

  • Small‑claims exception. Either party may pursue a claim in small‑claims court where permitted.

  • Consumer rights. If your jurisdiction disallows mandatory arbitration/class waivers, these apply only as permitted by law.


13) Changes

We may modify the Service or these Terms at any time. Material changes will be posted with an updated effective date and, where required, notified in‑app or by email. Continued use constitutes acceptance.


14) Platform Terms (Apple/Google)

  • Apple. Apple has no obligation to provide maintenance/support, warranties, or handle claims for the App. Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them.

  • Google. Google Play terms apply to downloads from Google Play; Google bears no obligations beyond its policies.
